Cell Phone Contact Policy

This policy describes how Jurtus identifies, flags, and restricts outbound contact to cell phone numbers in compliance with the Telephone Consumer Protection Act (TCPA).

1. Number Identification Upon Portfolio Acquisition

Upon acquisition of any debt portfolio, Jurtus undertakes a review of all telephone numbers associated with debtor accounts. This review is conducted prior to any outbound contact activity.

2. Cell Phone Detection and Flagging

Any telephone number identified as a cell phone — whether present in the original portfolio data or detected through number-type lookup at the time of acquisition or thereafter — is flagged within our account management system and restricted from outbound calling unless express written consent has been obtained.

This restriction applies regardless of the source of the number and is applied proactively before any contact attempt is made.

3. TCPA Compliance — No Calls to Cell Phones Without Consent

Jurtus does not place outbound calls to cell phones without prior express written consent from the debtor, as required under the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227.

Express written consent must be affirmative, specific, and documented before any call to a cell phone number is permitted. Consent inferred from the existence of a number in portfolio data does not satisfy this requirement.

4. No Automated Dialers or Prerecorded Messages

Jurtus does not use automated telephone dialing systems (ATDS), predictive dialers, or prerecorded or artificial voice messages in any capacity — whether directed at cell phones or landlines. All outbound calls, where permitted, are placed manually by a representative.

5. Alternative Contact Methods for Cell Phone Accounts

Debtors whose accounts have a cell phone number on file — and for whom no express written consent to call has been obtained — are contacted exclusively through:

  • Written correspondence sent via postal mail to the address of record; and/or
  • Email, where a valid email address is available in the account record.

No outbound phone calls are placed to such accounts until consent is obtained and documented.

6. How to Provide Consent

Debtors who wish to be contacted by phone may provide express written consent by contacting Jurtus directly at [email protected]. Consent requests must include the debtor’s full name, account reference number, the specific phone number to be called, and a clear statement authorizing Jurtus to contact that number.

Consent may be withdrawn at any time by written notice to the same address. Upon receipt of a withdrawal, the number will be re-flagged and restricted from further outbound calling within one business day.
